TEMPO TERMS OF USE

1. Purpose and acceptance

These Terms of Use govern access to and use of the TEMPO application (hereinafter, «TEMPO» or «the application»), developed and operated by KUMERA.
By downloading, installing or using TEMPO, you accept these Terms of Use and the Privacy Policy. If you do not agree, you must not use the application.

3. Description of the service

TEMPO is a personal wellbeing application for recording moments, emotions, reflections and experiences through tools such as Diary, Clima, Time Capsules and Pausa, with optional integration of sleep and physical activity data.
TEMPO is not a medical, psychological or emergency service. No feature of the application replaces the diagnosis, advice or treatment of a qualified professional. If you are going through a crisis or an emergency, contact your country’s emergency services or a healthcare professional. For guidance, the application shows helpline numbers: 112 for emergencies and, in Spain, 024.

4. Access requirements and minimum age

Using TEMPO requires being at least 16 years old.

If you are under 16, you may not use the application. The application asks for your date of birth at the start to check this.

5. User account

Most of TEMPO’s features (Diary, Clima, Pausa) work without needing to create an account, and the content stays on your own device. Creating an account (email, no password, using a one-time code) is only necessary to:

  • Activate encrypted cloud backup.
  • Send or receive Time Capsules from other people.

You are responsible for keeping access to the email address associated with your account. TEMPO has no way to recover your encrypted content if you lose access to your email and do not keep your recovery code (see Privacy Policy, sections 7 and 8).

6. Time Capsules

6.1 Your own Capsules

Each account has one free Capsule for life, for yourself. Sending additional Capsules to yourself, beyond the first, may require a TEMPO Pro subscription once this feature is available (see section 9).

6.2 Capsules sent to another person

Each account has one free send of a Capsule to another person, for life. Additional sends may require a TEMPO Pro subscription once it is available (see section 9). When you send a Capsule to another person:

  • You are responsible for the recipient’s email address being correct and for that person agreeing to receive content from you.
  • If the recipient does not yet have a TEMPO account, the content is protected through access controls, but is not end-to-end encrypted until that person joins the application (see Privacy Policy, section 7bis).
  • The recipient can block a sender to stop receiving Capsules from them, report inappropriate content, or hide a received Capsule.
  • For abuse prevention purposes, there are technical limits on the number of Capsules that can be sent per day and to the same recipient within a period of time.

6.3 Prohibited content in Capsules sent to another person

It is not permitted to use this feature for harassment, spam, illegal content, threats, or any use contrary to these Terms or applicable law. KUMERA may suspend the account of anyone who breaches this.

You can report a Capsule from within the application or by writing to hola@kumera.es, which is also our point of contact under Regulation (EU) 2022/2065 (Digital Services Act); you can write to us in any of the application’s languages. If we remove content or suspend an account, we will tell the person affected why, and they can ask us to review the decision by writing to that same address.

7. Your content

The content you write in TEMPO (Diary entries, Capsules, Clima records, voice notes, photographs) is yours. We do not use it to train models, we do not sell it, and we do not share it with third parties except as described in the Privacy Policy. When content is end-to-end encrypted, KUMERA cannot access it under any circumstances.
You are responsible for the content you enter and for ensuring it does not infringe third-party rights or applicable law.

8. Health data

The optional Health feature (sleep, steps, heart rate and exercise minutes) is purely informative and correlational. It does not constitute medical advice and should not be used to make health decisions. See Privacy Policy, section 9.

9. TEMPO Pro

TEMPO offers, or may offer, additional features under a paid subscription («TEMPO Pro»). While this feature is not active, no functionality of the application requires payment.
Once TEMPO Pro is available, it will be governed by specific subscription terms (price, duration, renewal and cancellation) that will be shown before any charge, in accordance with the policies of the relevant app store (App Store/Google Play) and applicable consumer protection regulations.

10. Misuse

It is not permitted to:

  • Use TEMPO for illegal activities.
  • Attempt unauthorised access to other people’s accounts, systems or data.
  • Interfere with the functioning of the application or its servers.
  • Use the application to harass, threaten or harm third parties.
  • Reverse engineer the application except in cases permitted by law.

11. Suspension and cancellation

KUMERA may suspend or cancel access to an account that breaches these Terms, particularly in cases of abuse through the Capsules sent to another person feature.
You can delete your account and all your data at any time from Settings → Your account, in accordance with the Privacy Policy.

12. Intellectual property

TEMPO, its design, brand, code and own content (not the content you enter) are the property of KUMERA or of third parties who have licensed their use. No rights over them are granted other than use of the application in accordance with these Terms.

13. Limitation of liability

TEMPO is provided «as is». KUMERA does not guarantee that the service will be free of interruptions or errors. To the extent permitted by law, KUMERA will not be liable for indirect damages arising from use of the application.
Nothing in this section limits any rights that consumer protection legislation grants on a mandatory basis.

14. Changes to these Terms

We may update these Terms for legal, technical or functional reasons. Significant changes will be communicated through the application or through other appropriate means.

15. Governing law and jurisdiction

These Terms are governed by Spanish law.

If you are a consumer and live in another country of the European Union or the European Economic Area, this choice does not deprive you of the protection given to you by the mandatory provisions of the law of your country of habitual residence.

For any dispute, if you are a consumer you may go to the courts of your place of residence, and KUMERA may only bring proceedings against you before those same courts.
